Austek Asphalt Services Terms and Conditions

These terms and conditions form part of and are to be read in conjunction with the particulars contained in the Quotation

INTRODUCTION

For the purpose of this agreement, “Austek Asphalt Services ABN 59 158 696 505” is the asphalt services owner operator and where applicable its employees and representatives. “Customer” is the person receiving the asphalt services, “work” means the asphalt services and any associated services supplied, “site” means the place where the work is carried out and “equipment” means the plant and/or machinery used in the performance of the work.

1. ACCEPTANCE OF THIS QUOTATION

1.1. Acceptance of this quotation must be in writing stating any official order number where applicable.

1.2. Alternatively acceptance may be by the signing of the attached quotation.

1.3. By accepting the quotation you are agreeing to the terms and conditions as set out herein.

1.4. All quotations remain valid for 30 days.

1.5. Austek Asphalt Services reserves the right to withdraw from this quote prior to the commencement of work, with no liability to Austek Asphalt Services for any costs incurred by the customer for any reason.

1.6. The price does not include, unless otherwise stated in the quotation:-

1.6.1. Removal of any material from channels;

1.6.2. Any preparation required to the surface, apart from sweeping;

1.6.3. Any additional services not detailed in the quotation and the price is subject to vary should any additional work be required.

2. TERMS OF PAYMENT

2.1. A deposit of 20% is required to be paid prior to the commencement of any work.

2.2. Unless otherwise stated in the attached quotation, upon completion, all outstanding balances, including extras must be paid within 7 days.

2.3. No deductions or retentions will be made by the customer unless otherwise stated in the quotation.

3. CANCELLATION POLICY

3.1. If the customer cancels through no fault of Austek Asphalt Services ABN 59 158 696 505 within 24 hours of the work commencing we reserve the right to claim for any expenses incurred.

3.2. All cancellations must be via telephone.

4. CUSTOMER RESPONSIBILITIES

4.1. Prior to the commencement of any work the customer must:-

4.1.1. Obtain all necessary permits and/or plans and pay any fees payable to any local government authority in relation to the work.

4.1.2. Contact Dial Before You Dig at www.dialbeforeyoudig.com.au or phone 1100 in order to obtain appropriate plans and provide same to Ozoux Asphalt Services prior to work commencing.

4.1.3. Should the customer fail to do so the customer will indemnify Ozoux Asphalt Services for any claim for costs, expenses or losses.

5. WARRANTY

5.1. All work is warranted against defective materials supplied by us and workmanship for three (3) months from the date of completion.

5.2. This does not include defects occurring due to acts of nature, or erosion or any event or cause which is beyond the direct control of Austek Asphalt Services.

5.3. In the event of any work performed by Austek Asphalt Services being defective the liability of Austek Asphalt Services, if any, is limited to the replacement of such defective material and/or the redoing of such work. All other guarantees, undertakings, or representations expressed or implied whether arising from statute or otherwise are expressly excluded (except to the extent prohibited by law).

5.4.

ALL WORK IS WARRANTED AGAINST DEFECTIVE MATERIALS SUPPLIED BY AUSTEK ASPHALT SERVICES AND WORKMANSHIP FOR A PERIOD OF THREE (3) MONTHS FROM THE DATE OF COMPLETION OF WORK.

BEFORE ANY DIGGING IS MADE DURING PREPARATION, WE WILL CALL DIAL BEFORE YOU DIG. IT WILL BE THERE RESPONSIBILITY TO MARK ALL UTILITY LINES. AUSTEK ASPHALT SERVICES WILL NOT BE RESPONSIBLE FOR ANY DAMAGE DONE TO UNMARKED UNDERGROUND WIRING.

THE BASE IS THE MOST IMPORTANT PART OF ASPHALT PAVING. THIS PART OF OUR WARRANTY IS NOT COVERED IF THIS WAS SUPPLIED & LAID BY ANOTHER COMPANY.

CRACKS DEVELOPING FROM TREE ROOTS CAN NOT BE AVOIDED. AS TREES GROW SO DO THE ROOT SYSTEM AND THIS IS NOT COVERED UNDER OUR WARRANTY.

WHEN RESURFACING OVER OLD CONCRETE OR ASPHALT CRACKS CAN APPEAR AND THIS WILL NOT BE COVERED UNDER WARRANTY

WE RECOMMEND BACK FILLING WITH TOPSOIL, ROCK OR GRAVEL AS A PRECAUTION TO AVOID CRACKS THAT MAY DEVELOP ALONG OPEN EDGES OF ASPHALT.

SHOULD A HAIRLINE CRACK DEVELOP IT DOES NOT REQUIRE ANY CORRECTIVE ACTION, HOWEVER SHOULD IT EXPAND ¼” WIDE BY ¼” DEEP WE CAN APPLY A LIQUID CRACK FILLER & THIS WILL BE COVERED ONLY IN THE FIRST YEAR .

6. DISPUTE

6.1. The customer must within 7 days from the date of the completion of work advise, in writing, Austek Asphalt Services of any alleged disputes. Failing to do so will result in Austek Asphalt Services assuming that all work has been completed satisfactorily and that the work is free from any disputes.

7. DAMAGES

7.1. The customer must pay to Austek Asphalt Services all costs and expenses of Austek Asphalt Services for the purpose of recovering any costs due to the failure of the customer to pay an outstanding invoices. This includes but is not limited to any expenses incurred in debt recovery and legal costs incurred by Austek Asphalt Services.

7.2. Austek Asphalt Services may charge interest at the rate of 2% for any outstanding invoices not paid within 30 days.

7.3. Until payment has been made in full Austek Asphalt Services retains all legal and equitable title to all materials and other items which might incorporate the materials and the customer authorises Austek Asphalt Services to re-enter onto the site for the purpose of retaking delivery if payment is not made when due.

8. GENERAL

8.1. Unless otherwise stated, materials and laying will comply with the Australian Standard Specifications.

8.2. Testing will not automatically be carried out and will only be undertaken if requested by the purchaser prior to delivery and at the cost of the customer.

8.3. Austek Asphalt Services is not responsible in any manner for delays in delivery or non-delivery (or any costs associated with same) which are attributable to transport delays, plant or equipment breakdown, unavailbilty or shortage of materials, industrial stoppages or any other cause which is beyond the direct control of Austek Asphalt Services.

8.4. Ozoux Asphalt Services will not be responsible for any maintenance after the completion of work.

8.5. Austek Asphalt Services will not be responsible for any property damage caused in the carrying out of the required work except in instances where the damage was directly caused by the negligence of Austek Asphalt Services employees or agents. In which case the customer will be notified within 24 hours of its occurrence.

8.6. Clerical and technical errors are subject to corrections at any time by Austek Asphalt Services.
